Perivane Terms and Conditions

These Terms and Conditions ("Terms") govern your use of Perivane at perivane.com, a service of Indie Pen Press LLC ("Indie Pen Press," "we," "us"), Gig Harbor, Washington, USA. By submitting a manuscript and completing payment, you agree to these Terms and to our Privacy Policy.

1. The service

Perivane reads a finished manuscript and produces a set of cited reference documents to help you launch and promote your book: a Master Reference, a Chapter (or Section) Reference, an Editorial Continuity Report, and a Summary, plus series documents where applicable. It also provides marketing metadata (keywords, categories, comparable titles, a book description draft) and a machine-readable version for use with AI tools.

Perivane analyzes; it does not write your book. It never generates your story or your content. It reads what you have already written and reports on it.

2. Eligibility

You must be at least 18 years old and have the legal right and authority to submit the manuscript you upload, including all necessary rights from any co-authors or rights holders. By submitting, you confirm you have those rights.

3. Your responsibilities and acceptable use

You agree that you will not submit content that: - you do not have the rights to submit, or that infringes another person's intellectual property; - is illegal, or violates the acceptable-use policies of our service providers (including Anthropic); - makes prohibited or unlawful claims (for example, unsubstantiated medical or health claims such as claims to cure disease), or otherwise cannot be responsibly marketed.

We screen each submission before payment. If a submission is rejected for a technical reason (for example, an unreadable or wrong-format file), we will ask you to resubmit and will not charge you. If a submission is rejected because the content or book type is one we do not support or cannot process, we will decline it and will not charge you.

4. AI-assisted drafts; no professional advice

The reports are produced with the assistance of AI and are provided as drafts for you to review, verify, and finalize before you rely on or publish them. We do not warrant that every statement, figure, category, or recommendation is accurate or complete.

Sales and rank figures (for example, estimated sales per day) are estimates derived from public rank data, not measured results. Comparable titles, categories, and keywords are suggestions to confirm, not guarantees. Nothing in the reports is legal, financial, medical, tax, or other professional advice. You are responsible for verifying facts and for how you use the reports, including compliance with the policies of Amazon, IngramSpark, or any other platform.

5. Fees, payment, coupons, and taxes

Current prices are listed on our pricing page at perivane.com and shown again at checkout. A series is priced per book at a volume discount (a two-book series receives a discount on the second book; three or more books are priced lower per book). The total is always shown before you pay.
Payment is processed by Stripe. We store only a payment identifier and the amount, never your card details (see the Privacy Policy).
Coupon codes, where offered, are applied at checkout, are single-use unless stated otherwise, cannot be combined unless stated, and have no cash value.
You are responsible for any applicable taxes. Where we are required to collect tax (for example, EU VAT on digital services), it will be shown at checkout.

6. Refunds

Because Perivane is a digital service that consumes real processing cost once it runs, fees are non-refundable once processing has begun, except as required by law. If we reject your submission before payment (Section 3), you are not charged. If a genuine service failure on our side prevents delivery and we cannot resolve it, we will re-run the order or refund it at our discretion. To raise a concern, email info@indiepenpress.com.

7. Delivery

We aim to deliver your reports within 24 hours of a successful order (this is a target, not a guarantee). We deliver by email containing a secure, tokenized download link that is active for 14 days. If you lose access, we can re-issue a link from your retained files for up to 180 days after delivery (see the Privacy Policy for retention).

8. Intellectual property

You retain all rights to your manuscript and to the reports we deliver to you. We claim no ownership of your book or of the deliverables. You grant us a limited, non-exclusive license to process your manuscript and to use the necessary service providers solely to produce and deliver your reports. We retain ownership of the Perivane software, methods, templates, and reference data used to produce the reports.

9. Third-party services

Producing your reports requires third-party providers, including Anthropic (manuscript analysis), Canopy and Keepa (market data), Stripe (payment), and SendLayer (email). Their handling of data is described in our Privacy Policy. We are not responsible for the independent acts or omissions of these providers, though we choose them for their data-protection practices (notably, your manuscript is not used to train AI models and is retained by our AI provider only briefly).

10. Disclaimers

The service and the reports are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that any marketing outcome, ranking, or sales result will follow from using the reports.

11. Limitation of liability

To the fullest extent permitted by law, Indie Pen Press will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the service. Our total liability for any claim arising out of or relating to the service will not exceed the amount you paid for the order giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Indie Pen Press from claims, damages, and expenses arising from your breach of these Terms, from content you submit, or from your infringement of any third party's rights.

13. Privacy

Your submission and personal data are handled as described in our Privacy Policy, which is part of these Terms.

14. Suspension and termination

We may decline, suspend, or terminate service for a submission that violates these Terms, and we may refuse service at our discretion. Sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, indemnification, governing law) survive termination.

15. Governing law

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. The exclusive venue for disputes is the state and federal courts located in Washington, to the extent permitted by law.

16. Changes to these Terms

We may update these Terms as the service evolves. The revised version will be posted here with a new "Last updated" date. Material changes will apply to orders placed after the change.
